Can you travel with CBD oil anywhere?

To answer the question simply, yes. You can absolutely travel with your CBD oil.

However, you must be keen to know the general local laws that apply relating to CBD and its products.

Here are some tips if you are traveling by:

1. Car

If you are planning on doing a holiday trip using your car, there’s probably very little to make you worried. As you are not likely to be crossing any borders in the possession of your CBD, the knowledge you already have of your local laws should be sufficient.

The general rule is to have a THC level that is below the set legal limit of 0.3%. Because hemp-derived CBD is not treated in the same manner as CBD products that have been derived from marijuana, you will not even need to conceal it in a container or declare its possession in case you get stopped. Carrying CBD is definitely not a “ticketable offense” as long as CBD has been legalized in your country.

2. On the Train and Other Means of Mass Transit

Similar rules apply when you are traveling with CBD oil either by train or other means of “mass transit”. Hemp-derived CBD that has a legal amount of cannabinoids is okay to bring onto the train or bus as long as you are traveling within your countries’ borders.

Can I Fly With CBD Oil?

You are now allowed to fly with CBD oil in your possession as long as it has been derived from hemp and it contains less than 0.3 percent THC.

This is a relatively new development that was updated in the spring of 2019. This came after the implementation of the 2018 Farm Bill that legalized the growing of hemp. With the listing of CBD oil as a “non-harmful substance”, that is partially controlled by the USDA, TSA has now removed it from the “cannot fly” list.

Apart from hemp-derived CBD oil, it is also legal to travel with CBD in the form of Epidiolex. This is the only FDA-approved drug that has CBD as its active ingredient. Epidiolex is used in the treatment of epilepsy. Research has shown that it has been massively successful in reducing intractable seizures, especially in children.

Can You Fly With CBD Oil Outside The US?

The laws relating to carrying CBD oil across borders are quite similar to those of TSA. Though flying with CBD oil was once a cause for concern, especially when traveling across State or Country lines, a lot has changed in the recent past.

If you are planning to fly with CBD oil, keep in mind the 3.4-ounce rule which applies to all liquids. If you plan to bring it in your “carry-on” luggage, ensure that it doesn’t exceed 3.4 ounces.

If you need to carry a larger quantity than that, include it in your checked baggage, while taking care to pad it properly ensuring it doesn’t break or pop open.  

CBD oil derived that has been derived from hemp is what is legally recognized by TSA. To date, FDA is yet to approve another prescription drug or prescription medication that contains cannabis in any form.

Therefore, only CBD products and Epidiolex are safe for flying legally.

Lucky for us, CBD oil falls in this category.

If you are traveling to Europe you need to ensure that the THC does not exceed 0.2%, in this case, you will be safe.

If you are traveling to Canada or Portugal then you need not worry about exceeding the THC limit since recreational weed with higher THC is legal in these countries. However, you will be subject to the airline’s limit on liquids (normally 100ml in Canada).

If you need to carry any other form of cannabis across state borders, you need to confirm the laws that apply there as well. If for example, you are carrying medical marijuana from one state that allows it like Oregon, to another state that allows it, like Washington, you have absolutely nothing to worry about. In the same breath, if you happened to be moving from Washington to Idaho, your possession might cause you problems and you could face possession penalties as marijuana is not legal in Idaho.

So, unadulterated hemp-derived CBD oil passes the test, but you might want to be more careful if you are considering traveling with other products of cannabis.

Can You Travel With CBD Cream?

Like CBD oil, the regulation of CBD cream is not the same all over the world, or even in different states. Depending on your destination, there are restrictions on what you can and cannot travel with.

For all creams, edibles, lotions, gels, oils, and other liquids, it is imperative that you comply with the normal TSA 3-1-1 rules. Though you don’t need to declare your cream separately, you should also not hide it. While the statement made by TSA seems to make it appear like they are not on the lookout for cannabis products, you are still subject to a search that could detain you at an airport for hours.

Despite the “2018 Farm Bill “ that made CBD and hemp legal at the Federal Level, the sale and possession of CBD can still be made illegal by individual states.

The most current statement on the TSA website states that:

“Possession of marijuana and cannabis infused products, such as Cannabidiol (CBD) oil, is illegal under federal law…. TSA security officers do not search for marijuana or other illegal drugs, but in the event a substance that appears to be marijuana or a cannabis infused product is observed during security screening, TSA will refer the matter to a law enforcement officer.”

The following applies at federal levels:

  • Anything that contains more than 0.3% THC is classified as marijuana and therefore illegal at the federal level. This holds even if it is legal at the state level.
  • If the product in question does not explicitly show its THC content, it is liable for seizure
  • If a bottle has already been opened, TSA may confiscate it as its contents might have been substituted with more potent contents

What About Air travel With Tinctures?

As we have mentioned earlier, at check-point, you are allowed a quart-sized container of liquids, gels, aerosols, pastes, and creams in your carry-on bag.  These have to be 100 milliliters (3.4 ounces) or less per item.

As long as your tinctures contain the legal amount of THC (less than 0.3%), you can carry them on flight. If they are in packages that are more than 3.4 ounces, you can put them in checked luggage, again carefully insulated to protect them against bursting or popping.

What About Bringing Edibles On a Flight?

As we have already discussed, The TSA has recently issued statements on this. We, therefore, do not need to speculate on whether bringing canna-edibles on the flight is a viable option. They have first emphasized that they are not out to look for illegal drugs. If they suspect you to be in the possession of a substance they deem as illegal they will refer you to the local authorities, who will not arrest you if it is not illegal to possess weed in that state.

As it is impossible to tell the potency of most edibles, except the manufactured ones that have clear labeling. This is a grey area in which you need to use your discretion. You could probably get away with packing a small amount in an airtight container and putting it in your checked baggage. Most of the time, especially if the edibles contain less than 0.3% THC, you really have nothing to worry about. The risk would be getting detained for investigations and getting delayed or missing your flight altogether!
