Is Weed Legal in California? [Updated 2023]

Many states have made strides into legalizing weed, although federally, it’s still illegal to consume. California is one of the states that have allowed both medical and recreational use legal within the borders. Is weed legal in California?

California cannabis laws

California passed the law for the use of medical marijuana in 1996 under the Compassionate Use Act (California Legislative Information, 2017). In 2003, this was expanded by Senate Bill 420, which allowed state ID cards for medical marijuana patients. 

Is recreational weed legal in California? 

Recreational cannabis became legal in 2016 during a vote in California. 56% of voters approved Proposition 64, allowing adults over 21 to buy, use, and grow weed seeds within borders. Before the public could purchase recreational weed, a licensing system needed developing. The market opened on January 1st, 2018. 

For both medical and recreational cannabis use, buying, and growing, some regulations need to be followed under California marijuana laws (California Cannabis Portal, N.d). We’ll go more into depth with this later. 

Yes, you can buy California legal weed, but there are restrictions. You must be 21 years or older to buy cannabis seeds or products. The law allows you to possess 28.5 grams of marijuana product or 8 grams of the concentrated substance.

Can I grow my own cannabis in California?

Yes, California state allows you to consume marijuana legally, both recreationally and medically. You must be on private property or in legal consumption areas to do so, and you must be 21 years or older. 

It’s illegal to consume cannabis products in public for people of any age. If caught, there is a $1,000 fine, but you won’t get imprisoned. It’s also against the law to operate a vehicle while under the influence of marijuana. California penal codes allow police to get a blood or urine test if suspected of driving while high.

California medical marijuana laws

You can get your California medical card through your physician or by finding a doctor for an appointment. The medical professional will evaluate your physical and mental health to see if you qualify.

Once you receive your legal medical marijuana card, you can buy cannabis seeds, products, edibles, pills, and more. There are no possession limits for those with cards in California. Instead, the amount you can have gets based on the needs of the patients. 

Recreational marijuana laws

Recreational use and purchase are legal in California. Voters passed Proposition 64, or the Adult Use of Marijuana Act in 2016, making it a law. It began in January of 2018. There is a 15% cannabis tax with every purchase.

You’re allowed to buy weed seeds, products, and concentrations. You’re not permitted to sell marijuana products without a proper license. If caught doing so, it’s a $500 fine, misdemeanor, and jail time up to 6 months.
